FCRA & Permissible Use Notice

ProfileBolt is a research tool, not a background-check or consumer reporting service. It may not be used for employment, tenant, credit, insurance or other eligibility decisions.

Last updated: October 16, 2026

1. ProfileBolt is not a consumer reporting agency

SmartApz is not a “consumer reporting agency” as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. (“FCRA”), and the information available through ProfileBolt is not a “consumer report”. ProfileBolt has not been designed or tested to meet the accuracy, dispute-resolution and notice requirements that the FCRA and similar laws impose on consumer reports, and it must not be used as one.

2. Uses that are not permitted

You may not use ProfileBolt, or any information obtained from it, in whole or in part, as a factor in establishing a person’s eligibility for, or in making any decision about:

  • employment — including hiring, promotion, reassignment, retention, contracting or volunteer positions, and pre-employment or ongoing background screening;
  • housing — including tenant screening and rental, lease or purchase decisions;
  • credit — including loans, financing, leases, collections and account reviews;
  • insurance — including underwriting, pricing and claims;
  • government licences or benefits, or any professional licence that requires consideration of a person’s financial responsibility or status;
  • a business transaction initiated by the person in which the eligibility of that person is being evaluated; or
  • any other purpose described in section 604 of the FCRA (15 U.S.C. § 1681b) or covered by similar state laws, such as the California Investigative Consumer Reporting Agencies Act.

3. Not for hiring decisions — use a licensed screener

ProfileBolt is not built or marketed for employment screening. It must not be used to screen, rank, reject or otherwise evaluate a job candidate, employee, contractor or volunteer, or to verify their background.

Need FCRA screening? Use a licensed background-screening company (a consumer reporting agency) that complies with the FCRA, and follow the requirements that apply to you, including the required disclosures, written authorization, and pre-adverse and adverse action notices. Many states and cities also restrict when and how criminal history and other background information may be considered.

4. Your certification

When you create an account, and before you run searches, you certify that you will use ProfileBolt only for lawful purposes permitted by the Terms of Service and the Acceptable Use Policy, and not for any purpose covered by the FCRA or similar laws. This certification applies to every search you run.

5. Consequences of misuse

Using information from ProfileBolt for an FCRA-covered purpose may expose you to civil and criminal liability under federal and state law. We may suspend or terminate any account that we believe has used the Service for a prohibited purpose, and we may cooperate with authorities investigating such use. You are responsible for any resulting claims, as set out in the indemnity in the Terms of Service.

6. Questions

If you are unsure whether a planned use is permitted, do not proceed — email legal@profilebolt.com first.
